1. Subject

These General Terms and Conditions of Sale govern the purchase of products made remotely through the website www.erbagil.com, managed by:

Sales are regulated by Legislative Decree no. 206/2005 (Consumer Code), Legislative Decree no. 70/2003 regarding electronic commerce, Regulation (EU) 2016/679 (GDPR) and the applicable current legislation for distance contracts.

2. Acceptance of the Terms and Conditions of Sale

By placing an order on the website, the Customer:

  • Fully accepts these General Terms and Conditions of Sale.
  • Confirms having read the legal information, privacy policy, and purchasing methods.
  • Undertakes to print and keep a copy of these conditions, as required by current legislation.

3. Registration and Account

Website registration is free. The Customer can create an account or purchase as a "guest".

  • The data entered must be truthful and complete.
  • The Customer is responsible for the storage and use of their Access Credentials.
  • In case of loss or misuse of credentials, ERBAGIL S.R.L. declines all responsibility.

4. Purchase Methods

Products available in the online catalog can only be purchased through the website www.erbagil.com.

Once the order is sent, the Customer will receive an Order Confirmation via email, containing a summary of the data and the Order Code.

It is the Customer's obligation to check the accuracy of the entered data and communicate any corrections promptly.

5. Prices and Expenses

All prices are expressed in Euros (€), inclusive of VAT.

Any shipping costs or additional charges (e.g., cash on delivery) will be indicated and calculated before the order is placed.

6. Payment Methods

Available payment methods are:

  • Credit card (Visa, Mastercard, American Express, Postepay etc.)
  • PayPal
  • Advance Bank Transfer
  • Cash on Delivery (only for orders under € 300.00 with an additional cost of € 5.00).

7. Delivery

Shipments are made via GLS courier.

Delivery times:

  • Italy: 2 working days (islands and remote areas may experience delays).
  • Abroad: to be agreed upon with the Customer.

Upon shipment, the Customer will receive a tracking code to monitor the order status.

Responsibility: ERBAGIL S.R.L. is not responsible for losses or deliveries to persons other than the recipient.

8. Legal Guarantee of Conformity

All products are covered by the Legal Guarantee of Conformity provided for by articles 128 et seq. of the Consumer Code.

9. Right of Withdrawal

The Customer has the right to withdraw from the contract within 14 days of receiving the goods, without having to provide any reason.

The product must be returned intact and complete, with all accessories and, where possible, in its original and complete packaging. The absence of packaging does not result in the loss of the right of withdrawal, without prejudice to the Customer's responsibility for the diminished value of the goods.

Withdrawal Procedure

The Customer can exercise the right of withdrawal using the dedicated electronic function "Withdraw from the contract", available on the website and easily accessible. The procedure involves:

  1. Selecting the withdrawal function via the dedicated button or link;
  2. Confirming the intention to withdraw from the contract through a dedicated screen, where the Customer must indicate their name and the order or contract reference for which they intend to exercise the right of withdrawal;
  3. Automatic sending by the Seller of a confirmation of receipt of the withdrawal request on a durable medium, containing the date and time of the request, usually via email.

When making the request, the Customer has the option—but not the obligation—to indicate the reason for withdrawal and attach any photographic documentation.

Products must be returned within 14 days to the address: ERBAGIL S.R.L., Località Santa Lucia, SNC, 82034 Guardia Sanframondi (BN), Italy. Return shipping costs are borne by the Customer.

Refund: The refund will be made within 14 days of receiving the return, using the same payment method chosen by the Customer.

12. Competent Court

In case of disputes, the competent court is:

  • The Court of Benevento, if the Customer is not a consumer.
  • The Customer's place of residence, if qualified as a consumer under the Consumer Code.

13. Intellectual Property

All content on the site (texts, images, logos) is the exclusive property of ERBAGIL S.R.L.

Any reproduction without written authorization is prohibited.

Pursuant to articles 1341 and 1342 of the Civil Code, the Customer declares to have read and fully accepted these General Terms and Conditions of Sale.
